In order to use the service you must read and accept these terms of service and privacy policies.

Selfloops s.n.c. with website https://www.selfloops.com provides fitness services and accessories to sport enthusiasts and professionals that want to track, analyze and improve their own performance. Selfloops is an Italian company and the terms of service and conditions are rendered in accordance with the Italian law and jurisdiction.

Selfloops provides an Internet service, mobile applications and accessories to track and analyze fitness activities. The service is provided as is, and Selfloops is not liable for incorrect or incomplete information, or improper use of the data of the services. Selfloops cannot be held liable for damages, loss of income, business interruption, loss of data or other losses or damages associated with the use of its services. Selfloops can suspend, change or interrupt any of the services it offers without prior notices.

All content in the SelfLoops services, including images, text, software and hardware are property of SelfLoops and protected by intellectual property laws covered by the Italian legislation. Copy, distribution of the content and reverse engineering of the software, website and hardware are prohibited. Downloading some parts of the Selfloops website, such as images and text is allowed only for personal, private and non commercial use.

Posting of offensive, discriminatory, racial, pornographic or illegal material is prohibited and the consequence is an immediate termination of the service. Unapproved commercial messages or advertising, is not permitted. The administrators can any time remove the content, or suspend an account that does not adhere to the terms of service without prior notice and Selfloops shall not be held liable to you or any third party because of such termination or action.

You expressly agree that Selfloops is not providing medical advice via the website (including text, photographs, images, illustrations, videos, audio and other material created by Selfloops or any other user or third party). Consult or ask for the advice to your physician or other medical professionals for any health related questions.

You expressly agree that your athletic activities carry certain inherent and significant risks of property damage, bodily injury or death and that you voluntary assume all known and unknown risks associated with these activities even if caused in whole or part by the action, inaction or negligence of Selfloops or by the action, inaction or negligence of others. You expressly agree to release Selfloops, its subsidiaries, affiliates, officers, agents, representatives, employee, partners and licensors from any and all liability connected with your athletic activities, and promise not to sue those parties for any claims, actions, injuries, damages, or losses associated with your athletic activities, use or misuse of training programs created by SelfLoops or any third party, use or misuse of equipment created by SelfLoops or any third party.

You understand that the Selfloops platform is intended to be used in connection with athletic and fitness and sport activities. In becoming a user of Selfloops, you affirm that you have consulted your physician in connection with any athletic and fitness activities that will be performed on the Selfloops platform.
Discontinue any use of the platform or engaging in any such athletic or fitness activities that cause you pain, fatigue, discomfort, nausea, dizziness, or shortness of breath and consult a medical expert. You expressly agree that Selfloops does not assume responsibility for the inspection, supervision, preparation, or conduct of any race, contest, challenge, or group activity that utilizes the services, including any that are organized by a Team administrator.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. The total liability of Selfloops and the other Selfloops Parties for any claim arising out of or relating to these Terms or our Platform, regardless of the form of the action, is limited to the greater of 50€ or the amount paid by you to use our Platform the 12 months preceding the claim. The limitations set forth in this section will not limit or exclude liability for the gross negligence, fraud or intentional misconduct of Selfloops or the other Selfloops Parties or for personal injury, death or property damage caused by the Platform or products purchased through the Platform, or for any other matters in which liability cannot be excluded or limited under applicable law. To the fullest extent permitted by applicable law, you release Selfloops and the other Selfloops Parties from responsibility, liability, claims, demands and/or damages (actual and consequential) of every kind and nature, known and unknown (including claims of negligence), arising out of or related to disputes between users and the acts or omissions of third parties. If you are a consumer who resides in California, you hereby waive your rights under California Civil Code § 1542, which provides: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”

We welcome comments, feedback, suggestions, and other communications regarding our website, applications and the services we provide. You are not obligated to provide feedback to us and in the event that you provide us feedback, you hereby grant to Selfloops a worldwide, non-exclusive, transferrable, assignable, sub-licenseable, perpetual, irrevocable, royalty-free license to copy, distribute, create derivative works of, publicly display and perform and otherwise exploit such feedback and to use, make, have made, sell, offer for sale, import and export products and services based on such feedback. If you do not wish to license your feedback according to our terms described here, please do not send us any feedback.

By using our services you grant the consent to Selfloops to manage and process your data according to our terms of services and privacy policy.

In order to use the service you must be older than 16.

Selfloops reserves the rights to change the Terms of Service or Privacy Policy at any time. You must accepts the conditions to be able to use the service or access may be denied.

User Accounts and Account Security

As part of the registration process, each user will submit his or her email address and select a password. If you register for an account to use our Platform, you must provide accurate account information (except that pseudonyms are permitted for usernames) and promptly update this information if it changes. You agree to access and use only those areas of the site and applications that have been authorized for your use and to refrain from using any password or account information of any third party. You agree to immediately notify Selfloops of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password. You shall be responsible for maintaining the confidentiality of your password. You agree not to disclose or share your password or other relevant account information with any third parties or to use your password for any unauthorized purpose.

Orders and premium services

The user may enroll in premium subscription services. Payments are withdrawn when the subscription is made.

In order to place an order, you have to explicitly accept the terms and conditions. We consider an order binding when you accept the terms and submit the order by pressing the submit button.

All order transactions are secured using SSL encrypted connections. We use commercial payment gateways such as Paypal and Stripe for secure payments, they are certified by the major credit cards and PCI compliant. When you provide your payment information, you authorize us and certain third party service providers, payment card networks and payment processors to receive, store and encrypt your payment information.

A valid subscription will give you access to a service for a certain period (membership period). The membership period and its cost are clearly identified prior to the purchase. You have a legal right to withdraw purchases made via our platform within 14 days from the date of purchase of your membership; provided that you have not logged in or otherwise redeemed or started to use the services. If you purchase a monthly subscription, we will automatically bill your payment every month. You may cancel your subscription at any time, and you will continue to have access to the service through the end of your membership period. You must cancel your membership at least 24 hours before the end of each billing cycle in order to avoid being billed for the next month's membership. Selfloops may offer subscriptions with monthly installments. In this case, the subscription duration is specified at the time of purchase and you will be billed every month until the end of the period. You can cancel the subscription in installments within 14 days from the date of purchase; provided that you have not logged in or otherwise redeemed or started to use the services offered.

Selfloops may change the prices of its products and services at any time. Changes to the prices will not affect any order for products or services you have already placed except that for auto-renewing memberships price changes will take effect when indicated in our email notice to you. To the fullest extent permitted by applicable law, you are responsible for any applicable sales, use, duty, customs or other governmental taxes, levies or fees (“Taxes”) due with respect to your purchase through our Platform.

Return policy for physical goods and merchandise

If you are not satisfied with your purchase or you may want to return for any reason, you can get a full refund if you return, at your expense, the merchandise unopened and undamaged within 14 days of receipt.

Defective devices covered by limited guarantee will be replaced. The customer is responsible for returning the product back to us including shipping costs and pickup by shipping carrier.

Damage caused by misuse or improper or unauthorized maintenance is not covered.

We may test the devices that are returned and impose the return shipping fees plus 15 percent of the product if the customer misrepresents the condition of the product.

Shipping

We ship our goods from EU. Given the current regulations, for orders shipped outside the EU there may be local and import taxes to be paid. These taxes and regulations varies for each country and we cannot calculate in advance these costs. For these reasons, the customer is responsible for providing the customs the needed information for clearance and paying the duty.

Privacy policy

Your privacy is important to Selfloops. We developed this Privacy Policy to provide you with information on how we process your personal data when you create a Selfloops account.

“Personal data” is information relating to an identified or identifiable natural person.

Categories of Personal Data Processed by Selfloops

Personal data that is processed when you create a Selfloops account:

When you create a Selfloops account, we ask you to provide your email address and name. You can choose to provide only your first name or a nickname instead of your full name if you wish.

Legal grounds and purposes:

(a) Selfloops processes your email address because you use your email address and your password to sign in to your account. The legal ground for processing your email address for this purpose is based on Selfloops’ legitimate interest in protecting the security of your account.

(b) Selfloops also processes your email address for the purpose of sending you important information about your Selfloops products, apps or account, such as important safety information or material changes to this Privacy Policy. The name you provide is associated with your account profile, and is displayed when you submit comments or other material on a Selfloops website or app. The legal ground for processing your email address and name for these purposes is Selfloops’ legitimate interest in providing you important safety or other information about your Selfloops products, apps or account or material changes to this Privacy Policy, and in providing you an opportunity to engage with other Selfloops users.

(c) Selfloops will also process your email address for the purpose of sending you marketing information about Selfloops products and apps. The legal ground for processing your email address for this purpose is your consent. You may withdraw your consent at any time by changing your preferences in your Selfloops account or through the unsubscribe link at the bottom of our marketing emails.

Additional personal data that is processed if you choose to provide it when you create a Selfloops account:

You can add additional information to your profile, such as your location, gender, birthdate, phone number, height and weight.

To fully utilize the service, you may want to connect to sensors that enables the gathering of the information about your training activities. The sensors we supports collect information on speed, distance, cadence, bike power, weight, steps taken, heart rate, temperature, humidity, altitude. In the future we may support additional sensors. The sensors enhance the ability of the service to track and measure your performance. Furthermore, the service uses location technologies such as GPS, to locate your position. However, as the user of the service, you can decide which sensors to enable for your activity and whether to enable or disable location tracking.

Legal ground and purpose:

This information is used to calculate the calories you burn during an activity. The legal ground for processing this information for these purposes is your consent. You can withdraw your consent by deleting this information from your account profile.

Personal data that is processed when you choose to upload your activities, location and activity data to Selfloops:

You can choose to upload activities (e.g., runs, walks, swims, hikes, etc.) and activity data (e.g., steps, distance, pace, activity time, calories burned, heart rate, sleep, location, etc.) from your device to your Selfloops account. You can use your device without providing your consent to upload your activities to Selfloops. If you choose to upload your activities to Selfloops, you control whether others can see your activity data by managing the privacy settings in your Selfloops account. Your activity data is set to “Private” by default.

Legal ground and purpose:

Selfloops processes your activity data, if you choose to upload it to Selfloops, to enable you to analyze your activity data, see your location on your activity course and segment maps, see your heart rate related metrics such as stress score, track your fitness goals, and, if you wish, share your activity data with others. If you reside in the European Economic Area or in Switzerland, the legal ground for this processing is your explicit consent, which you can withdraw at any time within your Selfloops account.

Personal data that is processed when you connect your Selfloops account to a third-party app if you choose:

If you choose to enable your Selfloops account to access accounts you have with other app providers, such as your Strava, Garmin, Polar, Concept 2, RunGap, Nokia Health (Withings), Bryton or HealthFit account, we will obtain information about you from such account, such as the number of calories consumed in a particular day based on information from your account or courses and segments from your Strava account.

Legal ground and purpose:

This information is used to supplement your activity information in Selfloops with information you have provided to such third-party apps. The legal ground for this processing is your consent. You can withdraw your consent at any time by disconnecting your Selfloops account from the third-party app within your account.

Categories of Recipients of Personal Data

LiveTrack

Livetrack is a feature available on Selfloops that enables you to send a link to people of your choice that allows them to see the real-time location of your device. Because anyone with access to the link will be able to see the real-time location of your device, you should use caution in determining to whom you want to send the link and be sure that you trust them to not send the link to others whom you do not want to be able to view the location of your device.

The telemetry service allows the streaming of the activities and the related metrics to our services. The users can share the live streaming events in the main social networks such as Facebook and Twitter. Once shared people that have the URL (Uniform Resource Locator) can access the activity in live streaming. Sharing of the live streaming events (telemetry) or posting of the summary of the trainings in the social networks can be enabled in the application and requires an explicit action by the user.

If the user is part of a team, the coach can follow the telemetry (live streaming) event. The user can disable its real-time tracking anytime by stopping to use the app.

Live Streaming

Selfloops offers the ability to stream data and video. Live data is any data collected during a workout, for example, cadence, speed, heart rate, location, power, etc. Live streaming events can be organized by a coach and an athlete can take part of the live streaming event by being part of the team and using a Selfloops application. A live event may involve one or more people and you may share the data with the group. The athlete can stop sharing the data by stopping to use the application or by exiting from the team at any time.

Third-party app, platform or service providers with whom you ask Selfloops to share your data

If you choose to authorize Selfloops to permit a third party, such as your wellness program provider, or an app, such as, Strava, or HealthFit, to access your activity data in your Selfloops account, then we will share such data with the third party. We will not do this without your explicit consent. Once you direct us to share data with a third party, the third party’s handling of your personal data is the responsibility of that third party and you should carefully review the third party’s privacy policy. You can choose to stop sharing data with the third party app, platform or service provider at any time within your Selfloops account.

Sharing your data with a coach

If you join a team in Selfloops coaches in that team will have access to your workouts, health and personal data stored in your account. Access to the data is necessary for a coach to provide coaching and advice. As an athlete, you can remove yourself from a team at any time and you will stop the sharing immediately within the Selfloops platform. At the same time, once you share data with a third party, the third party’s handling of your personal data is the responsibility of that third party and you should carefully review the third party’s privacy policy and contact the coaches in that team for any questions you may have about your data.

Cookies and Similar Technologies

To help analyze how you and other visitors navigate the Selfloops website, compile aggregate statistics about site usage and response rates, help diagnose any problems with Selfloops’ servers and administer the website, we, with assistance from third-party analytics service providers, collect certain information when you visit our site. This information includes IP address, geographic location of the device, browser type, browser language, date and time of your request, time(s) of your visit(s), page views and page elements (e.g., links) that you click. We may use cookies, pixel tags, web beacons, clear GIFs or other similar tools on our site or in our email messages to assist us in collecting and analyzing such information. We use this information to provide better, more relevant content on our site, to identify and fix problems, and to improve your overall experience on our site.

If you do not want information collected through the use of these technologies, there is a simple procedure in most browsers that allows you to automatically decline many of these technologies, or to be given the choice of declining or accepting them.

ANALYTICS SERVICE:

CAPTCHA

  • We use Google reCAPTCHA service provided Google Inc. (Google) to protect your website and app from spam and abuse by keeping automated software out of our website. This plugin checks if you are a person in order to prevent certain website functions from being (ab)used by spam bots. This plugin query includes the sending of the IP address and possibly other data required by Google for the Google reCAPTCHA service. For this purpose your input will be communicated to and used by Google. However, your IP address is previously truncated by Google within member states of European Union or in other states which are party of the agreement on the European Economic Area and is, as such, anonymized. Only in exceptional cases is a full IP address transmitted to a Google server in the United States and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address provided by reCaptcha from your browser shall not be merged with any other data from Google. This data collection is subject to the data protection regulations of Google (Google Inc.). Children

We request individuals under 16 not provide personal data to Selfloops. If we learn that we have collected the personal data from a child under 16, we will take steps to delete the information as soon as possible.

How We Protect Information

We take several measures to safeguard the collection, transmission and storage of the data we collect. Although we strive to employ reasonable protections for your information that are appropriate to its sensitivity, we do not guarantee or warrant the security of the information you share with us and we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content. No system is 100% secure. The Services uses industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of personal information and credit card numbers. In addition, Selfloops’ secure servers protect this information using advanced firewall technology.

To help ensure that these measures are effective in preventing unauthorized access to your private information, you should be aware of the security features available to you through your browser. You should use a security-enabled browser to submit your credit card information and other personal information at the services. Please note that if you do not use a SSL-capable browser, you are at risk for having data intercepted.

Most browsers have the ability to notify you if you change between secure and insecure communications, receive invalid services identification information for the services you are communicating with, or send information over an unsecured connection. Selfloops recommends that you enable these browser functions to help ensure that your communications are secure. You can also monitor the URL of the services you are visiting (secure URLs begin with https:// rather than http://), along with the security symbol of your browser to help identify when you are communicating with a secure server. You can also view the details of the security certificate of the services to which you are connected. Please check the validity of any services you connect to using secure communications.

Disclaimer

While Selfloops continues to work hard to protect your personal information, no data transmission over the Internet can be guaranteed to be absolutely secure, and Selfloops cannot ensure or warrant the security of any information you transmit to Selfloops. Transmitting personal information is done at your own risk.

Retention of Personal Data

You can also rectify, restrict, limit or delete much of your information by logging into your account. We will retain your personal data as long as your Selfloops account is considered to be active. In addition, see below under “Your Rights” for a description of your right of erasure.

Selfloops does not sell your personal information. However, we may disclose certain personal information for a business purpose. When you make a request to download your personal information, we will include a list of the categories of personal information that we may have disclosed about you, as well as the categories of third parties to whom your personal information may have been disclosed.

Right of deletion

You have the right to request that we delete your personal information, subject to certain exceptions. After we receive and validate your request, we will delete your personal information, as well as direct our service providers to delete your personal information, unless an exception applies.

Categories of information we collect and disclose for a business purpose We collect the following categories of personal information from you in connection with the Services, as defined in the CCPA:

  • Identifiers, such as your real name, athlete ID, Internet Protocol address, email address, and other similar identifiers.
  • Personal information categories listed in the California Customer Records provisions, including physical characteristics, such as weight, and payment information, such as your credit card number.
  • Characteristics of protected classifications under California or federal law, such as your gender and age.
  • Commercial information, such as the record of purchase of your Summit membership.
  • Biometric information, such as your exercise data.
  • Internet or other electronic network activity information, such as session logs.
  • Geolocation data, such as the physical location of your recorded activity.
  • Electronic, visual, or similar information, such as photos.
  • Inferences drawn from any of the above information to create a profile reflecting your preferences, characteristics, behavior, abilities, and aptitudes and effort.
According to California law, personal information does not include:
  • Publicly available information from government records.
  • De-identified or aggregated consumer information.

We may update this Privacy Policy from time to time as we add new products and apps, as we improve our current offerings and as technologies and laws change.
